Mombasa, KENYA: Mombasa court on Friday dismissed the hate speech charges lodged against Mombasa Women representative Mishi Juma Mboko.

Ms Mboko had been charged with incitement to violence and ethnic hatred.

It was alleged that Ms Mboko uttered words intended to bring violence during 2014 Madaraka day celebrations held in Mombasa.

“Kenyans are going to bring a revolution to this country. Enough is enough, we are tired. The revolution is with the people and sovereignty is with the people. The revolution is with the people. People power! People power!” she had said.

Mboko denied the charges.

Mombasa Chief magistrate Julius Nangea said the prosecution had not proved its case beyond reasonable doubt.

“The words used by the accused person were not in any way incitement to violence; the prosecution failed to make a prima facie case against the accused,” Nangea said.

He also found that Mboko did not mention a specific community in her speech but was promoting a revolution of the people, which is not an offense.

Through her lawyer James Orengo, Mboko said she has no case to answer as there are no clear charges against her.

She was charged in court on 30th June 2014 after investigation against her was completed.

A spot check by Baraka FM at the busy market on Friday,  found that the traders have already moved into their new work stations easing congestion in the market; unlike a few weeks ago when the traders used to hawk their wares from the roadside while using umbrellas to shield it from the scorching sun.

“Our merchandise is now shielded from the sun and we can attend to our customers more comfortably.” She said.
