Nairobi, KENYA: The High Court has found former Ruaraka OCS Nahashon Mutua guilty of killing an inmate.

Nahashon Mutua was found guilty of murdering Martin Koome on the 19th of December 2013.

“The Prosecution has proved beyond reasonable doubt that the deceased was assaulted in the cell…The accused misused his authority under the Constitution,” she said.

Mutua was arrested after Director of Public Prosecution Noordin Haji concurred with Independent Policing Oversight Authority (IPOA) recommendation to have him charged with murder.

Mutua denied the charges maintaining that the deceased was drunk and was beaten up by fellow inmates. Koome was rushed to Kenyatta National Hospital where he passed away.

The prosecution however stated that the former OCS ordered Koome to immerse his head in a drum of water for about 30 minutes before hitting him with a rod on the head.

During trial, the court also heard that Mutua had tried to cover up the ordeal by implicating another inmate. Other inmates were promised to be released if they recorded the statement implicating one Kelvin Odhiambo.

Odhiambo was arrested and later released after the case was dropped 9 months later following investigations by IPOA.

Mutua will be sentenced on 20th December.
