DPP wants terror suspect transferred from Shimo La Tewa over security concerns

Mombasa, KENYA: Office of the Director of Public Prosecution (DPP) on Wednesday moved to court seeking a terror suspect detained at Shimo la Tewa main prison transferred to Manyani Maximum prison, on security grounds.

In a letter dated 3rd January 2016 and from officer in -charge of Shimo la Tewa prison, Nassir Ali Skanda was requested to appear in court on 4th January, eight days earlier than the hearing date; scheduled on 12th January, to have him transferred to Manyani prison.

“Transfer from one prison to another is a tool for enforcing security, discipline and good order in prison since they are all categorized based on security features and conducive for holding different risk levels.”  Read the letter.

Mr. Nassir Ali Skanda and Mr. Ali Ahmed Abdallah are accused of committing acts of terrorism at Nyali Reef Beach hotel in Mombasa.

They allegedly detonated  an improvised explosive device and damaged property in May 2014.

A source at Shimo la Tewa prison, told Baraka FM that the accused person was being transferred to Manyani after it emerged that he was allegedly radicalizing other terror suspects at the institution.

The letter quoted section 37 of cap 90 Laws of Kenya, confers power to commissioner of prison to remove a prisoner from any prison to any other prison from time to time.

The officer in-charge at Shimo la Tewa prison Samwel Nyutu, said that Nassir will be able to  attend his court proceedings in time, irrespective of where he is held.

He also assured the family that they will have the  opportunity to visit him; saying all prisons in the country are accessible.

The lawyer of the accused person Mr. Chacha Mwita, will on 12th January respond on application to have his client detained at Manyani prison before court gives further directions.
