Mombasa court stops IEBC from processing Sonko’s nomination papers

The High Court in MOmbasa has stopped the Independent Electoral and Boundaries Commission from processing former Nairobi Governor Mike Mbuvi Sonko’s nomination papers pending hearing and determination of case against him.

In a court order issued on the 18th of May, 2022, Justice John Mativo ordered IEBC to stop processing Sonko’s nomination papers pending hearing and determination of an application filed by Haki Yetu, Kituo Cha Sheria, and Transparency International against Mike Sonko Mbuvi Gideon Kioko, Wiper Party, and Independent Electoral and Boundaries Commission as the first, second and third respondents respectively.

Justice Mativo also ordered that both Application and Petition were certified as urgent and that both the Petition and the Application be served within three days. Upon being served, the respondents are to file their responses to both the Application and Petition within four days from the date of service.

“That pending the hearing of the Application and/or other further instructions from this Court I order that 3rd Respondent be and is hereby restrained from processing the 1st Respondent’s nomination papers to contest and vie for the office of Governor of Mombasa County and from clearing 1st Respondent for election into the office of the Governor of Mombasa County pending hearing and determination of this Application,” read Justice Mativo’s order.

The matter shall be mentioned for direction on the hearing of the Application and the Petition on 24/5/2022.
