Gatundu North MP loses parliament seat after court ruling

Gatundu North Member of Parliament Ann Wanjiku Kibe has suffered a blow after High court nullified her election.

The court  declared the seat vacant after it was found that the election was conducted in violation of the law.

According to Justice Weldon Korir’s ruling, Deputy Registrar has been directed to forward the ruling to the Speaker of the National Assembly for action to be taken.

He also directed the Independent Electoral and Boundaries Commission IEBC, to conduct a fresh election in the constituency.

The Gatundu North seat had been nullified earlier in 2013 but the court of appeal overturned the decision.

According to the Appellate court judges, the Constitutional and Human Rights Division of the High Court was to only handle the interpretation of the Constitution in the petition and not validity of the MP’s election.

On June 25 this year, the Court of Appeal ordered a fresh hearing of the petition challenging the MP’s qualifications that saw her contest for the Gatundu North seat three years ago.
