Nairobi, KENYA: Nation Media group (NMG) will have to pay businessman Jimmy Wanjigi and his wife sh.8 million over a fake obituary it published in 2018, after the high court ruled in his favor.

Jimmy had sued NMG and sought sh.100m as compensation for the false obituary claiming the tycoon was dead and will be buried in Lang’ata cemetery.

Wanjigi claimed that the fake obituary was a breach of security and caused him mental torture denying him the right to dignity by treating him as a dead person while he was still alive.

In their defense NMG claimed that the obituary was placed by a third party and carried the name of a different person ‘Jimmy Richard Wanjagi’.

Justice Wilfrida Okwany of the High Court however stated that NMG should not place blame on third party since they enjoyed profit from the sale of the day’s paper.

NMG will now be required to pay Jimmy Wanjigi and his wife Nzisa sh.4 million each for the damages.
