Babu Owino’s election as Embakasi East MP nullified

Nairobi, KENYA: Embakasi East Member of Parliament Babu Owino is the latest Member of Parliament to have lost his seat after court nullification.

The high court through Justice Joseph Sergon nullified the election on bases that it was marred with irregularities and violence which translate it to be not free and fair.

Following the ruling, the court has ordered Babu to pay sh 5 million.

The court, however, dismissed video evidence presented by the respondent since it did not meet the evidence threshold.

This follows the successful petition by his close challenge in the August 8 elections, Francis Mureithi that ended with a vote recount.

Mureithi claimed that in the vote recounts that was done, some of the ballot boxes and forms 34A were reportedly missing.

Babu had garnered 46,817 votes against the petition, Mureithi’s 42,501 votes.

Addressing the Media shortly after the ruling, Babu lawyer Edwin Sifuna said that they would appeal the ruling.

Babu on his side outside the court said that people’s victory has been postponed and this is no longer about Babu Owino but will of people on trial and they will finally emerge stronger and more focus than before.
