Father, sons sentenced to death for killing Kwale herdsboy

Kwale, KENYA: A father and his two sons have been sentenced to death for killing a herdsboy in Chidi, Kwale County.

Mudata Mwamumbo Ndolo and his two sons Mwachodo Mudata and Mwamumbo Mudata alias Madvi were given the death penalty, by the High Court in Mombasa, on Tuesday after they were found guilty of killing Silipano Ndooki three years ago.

In his judgment, Justice Asenath Ongeri said there was evidence that the three killed the minor by breaking his neck before dumping his body in a water pond.

“Upon evaluation of the evidence on record, I find that the accused persons acted jointly to murder Silipano Ndooki. Ndolo, who broke the boy’s neck, was assisted by Madvi, who got hold of the deceased, while Mudata carried the body to the water pond and placed a stone on it,” Justice Asenath Ongeri said.

The judge said there was evidence that the accused persons had a vendetta against the boy’s family after threatening to take revenge when about 800 herds of cattle belonging to the victim’s father entered his farm and destroyed crops.

Ndolo demanded for sh.60,000 as compensation for the crops that were destroyed and threatened to revenge if the amount was not paid.

According to the court, the vendetta against the victim’s family served as motive for the murder.

Medical reports produced in court confirmed the victim died of cervical spine fracture as a result of twisting of his neck.

The convicts have 14 days to appeal.
