Court of appeal upholds Babu Owino’s election as Embakasi East MP

Nairobi, KENYA: Embakasi East Member of Parliament Babu Owino’s election has been upheld by the court of appeal.

The court of appeal on Friday dismissed High court decision of nullifying Babu’s victory on the grounds that it was marred with irregularities.

Justice Mohamed Warsame’s decision was presided over by a three-judge bench and overruled Justice Joseph Sergons ruling saying the nullification was not according to the law.

Addressing members of the press few minutes after the court decision, Babu praised his lawyers for the wonderful job done and vowed to serve members of his constituency diligently.

“I would tell my opponents to wake up and move on. I also invite them to come and help me serve the people of Embakasi” Said Babu.

The petitioner, Francis Mureith, through his lawyer, however, stated that he would get a copy of the ruling and would consider going to the Supreme Court.

The election of Babu was canceled in a ruling by Justice Joseph Kiplagat Sergion citing election irregularities.
