Mombasa, KENYA: The Mombasa Court on Tuesday acquitted a suspect accused of defiling a 15-year-old girl in Changamwe Mombasa County.
Rama Kazungu allegedly defiled the girl for three consecutive days.
In his ruling, Mombasa principal Magistrate Henry Nyakweba said that the girl refused to call for help despite having been alone in the accused’s house at times.
“I don’t understand why the complainant refused to scream for help because the evidence shows the accused left her in the house as he went to work,” said Nyakweba.
Kazungu allegedly defiled the girl from May 28 to 30 May 2012 in Changamwe .
The court noted that the Doctor’s report showed that the girl was defiled but did not show the culprit or the date on which offense was committed.
In addition, Nyakweba said the public prosecution office failed to present sufficient proof of against the suspect
