Nairobi, KENYA: The High court in Nairobi has declined an application by the Director of Public Prosecution( DPP) to suspend the sureties for the release of suspects in the Sh. 9 billion National Youth Service scam.
Chief Magistrate Lawrence Mugambi agreed that the suspects be released pending the verification of the bail securities.
Mugambi on Friday ruled that he will examine the sureties and that the court will determine which ones to accept or reject.
Mugambi also said that the DPP could only make an objection against a specific property.
He added that the concerns raised by the DPP are legitimate but should be addressed to specific individuals, not generalized.
She further said it is the duty of the court to ensure that any security tendered or offered is free from foreseeable risk arising from any illegality.
The office of Director of Public Prosecutions through senior assistant DPP Daniel Karuri sought more time to verify the sureties and source of cash posted by Youth Affairs Principal Secretary Lillian Omollo and NYS Director General Richard Ndubai.
Youth Affairs PS Lillian Omollo and NYS Director General Richard Ndubai filed separate applications at the High Court seeking freedom pending trial.
Mrs Omollo, who had spent two weeks at the hospital’s private wing and left the KNH at 7.30am on Wednesday, wants her prosecution suspended pending the hearing and determination of the application.
