KHRC accuses NGO board of violating the constitution

Nairobi, KENYA: Kenya Human Rights Commission director George Kegoro has accused the Non Governmental organization NGO coordination board director Mohammed Fazul  of violating their constitutional rights by de-registering the commission.

In a media briefing in Nairobi on Tuesday, Kegoro accused Fazul of disregarding the KHRC constitutional rights and the authority of the judiciary.

This is after courts issued a ruling on the matter in favor of the commission in 2015; where Justice Louis Onguto found that  failure by the board to either give a notice or a hearing to KHRC before arriving at a decision to cancel the registration, was a violation of its constitutional rights .

He accused the board of harassing and intimidating the commission ,stating Fazul’s moves as baseless allegations.

“Mr Fazul who purportedly proceeds to de-register KHCR ,this is sadly yet another chapter in attempts to harass and intimidate KHRC at the hands of the NGO coordination board and more specifically Mr Fazul himself.” Kegoro said.

The board alleged that KHRC has operated illegal accounts, failed to abide by its statutory tax obligations, concealed transactions in relation to its board members and false declaration to the said board.

Kegoro said that the commission is weighing options one of them seeking a legal redress on the matter after the judgement of other related matters with the board were settled in courts in 2015.

He said that a such move is inclined towards,political motivation after the just concluded August polls where KHRC was engaged in electioneering matters.

He accused Fazul of failing to furnish them with letters of de registration of the entity, adding that the commission doesn’t have expatriates who are working under it.

On the other hand,the Board has written to the Directorate of Criminal Investigations urging it to immediately shut down the Africa Centre for Open Governance (AfriCOG) .

The Board’s Executive Director Fazul Mohamed has also advised the Central Bank of Kenya to freeze all its bank accounts since it is operating illegally.
