Miguna has been deported because he is not a Kenyan citizen – Matiang’i

Nairobi, KENYA: The Ministry of Interior and Co-ordination of National government has come out to defend their position of deporting lawyer Miguna Miguna, arguing that he was in the country illegally.

In a Statement seen by Baraka FM on Wednesday, CS Matiang’i ordered for the deportation of the self-proclaimed NASA general as his presence in Kenya was contrary to national interest.

“I hereby declare that Miguna Miguna who is not a citizen and whose presence in Kenya is contrary to national interest, be removed from Kenya to his country of origin Canada.” Read part of the statement.

Earlier, the Interior Ministry through its spokesman Mwenda Njoka on Twitter said that Miguna Miguna had revoked his Kenyan Citizenship.

“Miguna renounced his Kenyan citizenship years back, acquired Canadian citizenship & never bothered to reclaim Kenyan citizenship in the legally prescribed manner neither did he disclose that he had another country’s citizenship despite being a lawyer who should have known better,” Tweeted Njoka.

Miguna Miguna has however disputed this in a statement he issued after he landed in Amsterdam.

” I have never, ever renounced my Kenyan citizenship and will never do that. I’ve never even contemplated it. Fifth, the constitution is crystal clear: no one can invalidate or purport to cancel the citizenship of a Kenyan born citizen.” wrote Miguna.

Lawyers have however questioned the legality of Miguna’s deportation, saying that it was an infringement of his human rights.

“Under Article 16 of the Constitution, a Kenyan by birth even if dual Citizen, can never lose his citizenship… Under Article 17, a foreigner who acquired Kenyan citizenship can lose it … Miguna’s deportation violates our Constitution.” said lawyer Donald Kipkorir.

Nelson Havi who is one of Miguna’s lawyers has said that they will sue the state.
