Blow to Omar as judge refuses to recuse herself from hearing election petition

Mombasa, KENYA: Former Mombasa Senator Hassan Sarai Omar on Friday suffered a blow after his demand
seeking a judge presiding a case he filed to challenge the gubernatorial election in Mombasa recused, was dismissed.

In his application, Mr.Omar alleged that lady justice Lydia Achode showed some biasness during the hearing of the petition he filed in August.

Omar further alleged that Justice Achode has been allowing all applications filed by Governor Ali Joho but dismissed most of his applications filed during the hearing of the petition.

However, Justice Achode declined to recuse herself and ruled that the application filed by Omar lacked merit.

Achode said that the court is guided by the law and she was not biased as alleged by Mr.Omar.

She further directed that she will continue hearing the petition within the time set in the constitution.
