Court denies Joho orders to cross-examine Omar over affidavit

Mombasa, KENYA: A Mombasa court on Thursday denied orders to recall former senator Hassan Omar for re-cross examination by governor Joho’ s legal team.

Joho through his lawyer Mr.Mohammed Balala made an oral application before lady justice Lydia Achode requesting the court to allow them to cross-examine Omar over his affidavit seeking recusal of the judge hearing his petition.

Mr.Omar filed an application on 8th January seeking justice Achode to recuse herself from hearing the petition challenging Mombasa Governor Hassan Joho’s win during last year’s election.

He alleged that the court was being biased since it only granted applications filed by Mr.Joho and dismissed all applications made by Omar.

“When we wanted to examine Governor Joho on his academic qualifications we were stopped and yet it was on our petition,” said Abubakar (Omar’s lawyer).

The IEBC through its lawyer opposed Omar’s application to recuse saying it was a failure of legal representation of Mr.Omar.

“It was the duty of Abubakar to advise his client to make his unreasonable application,” said lawyer Paul Nyamodi.
