Governor Mvurya wants court to dismiss case challenging his victory

Kwale, KENYA: An election petition filed by Kwale voter Mwamlole Tchappu Mbwana seeking to nullify Governor Salim Mvurya’s election was on Monday adjourned following an application to have the petition struck out.

Governor Mvurya wants the petition struck out, citing the failure by Mbwana to enjoin the deputy governor Fatuma Achani.

The court allowed the application and directed Mbwana, Kwale county returning officer Amina Hussein and Matuga constituency returning officer Kassim Mwangombe, to file a response on Tuesday before the application is heard on Wednesday.

“The issue raised by Mr.Mvurya could have and ought to have been brought before the commencement of the hearing of the petition.” Said Thande.

The court allowed Mvurya’s application saying it raised issues of law which cannot be washed away.

Mr. Mbwana had moved to court to challenge Kwale gubernatorial results citing that election was not free and fair.
