Mombasa, KENYA: Two Lamu MCA’S who failed to honour court summons on Tuesday moved to high court seeking magistrate orders stopped.
This comes a week after Mombasa resident magistrate Martin Rabera issued a warrant of arrest against the two.
Nominated MCA Monica Kirunyi and Bahari ward MCA Antony Maina are accused of uttering words of incitement intended to cause violence.
They failed to appear in court to answer incitement charges despite being served with summons.
However, their lawyer Caroline Mbuko earlier told the court her clients were laymen and did not understand summons.
The complaint was lodged by the National Cohesion and Integration Commission through the office of Director of Public Prosecution.
Lady Justice Dora Chepkwony, Tuesday ordered the lower court proceedings against the two not to continue pending affidavit filed in court by two MCA’s.
Justice Dora directed matter to be heard on Wednesday.
