Mombasa, KENYA: A German citizen was on Tuesday convicted to 12 months in prison or pay a fine of sh 100,000 in a Mombasa court; this is after he pleaded guilty to the charge of being in the country unlawfully.
Court heard that Birtel Markus Deutch was arrested on 3rd October last year at Moi International Airport.
The accused person presented himself before immigration office at Moi International Airport seeking to be cleared to board flight DE2281 which was heading to Germany.
He presented a copy of his German passport number C351M53XM which was issued on 3/2/2016 in Germany; valid until 2/2/2026 a period of ten years.
When immigration officers were perusing his passport, they realized the accused person’s visa expired in August.
State prosecutor told the court that the accused person was a first offender and requested for repatriation.
His lawyer Vincent Mogaka told the court his client had married a Kenyan woman and came to visit the country as a tourist.
“He even earlier lost his passport and reported to Diani police station, he also told me he did not know his visa had expired,” Mogaka said.
In his ruling, Mombasa resident magistrate Martin Rabera said the Court considered mitigation of the accused person and ordered him to pay a fine of sh. 100,000 or serve 12 months in prison.
Rabera also ordered him repatriated upon payment of a fine or serving sentence.
