Ford Kenya defectors to lose legislative seats, Khalwale appointed Deputy party leader

Nairobi, KENYA: Kakamega Senator Bonny Khalwale has been elected as Ford Kenya’s deputy party leader, replacing Lungalunga legislator Khatib Mwashetani ‘s position in the party, after he defected to Jubilee.

In a press conference after the National Executive Council meeting on Thursday in Nairobi, party leader Moses Wetangula said that Joel Rugu will take chairman position which was held by Turkana senator John Munyes who defected to Jubilee party.

However ,Wetangula said that his party will not hesitate to take action against members who defected to Jubilee party; as there fate lies within the bye election which the party has vowed to effect soon.

“We appreciate the law remains the law as we congratulate them we are also going to swing the sword of the law ,the law requires that when you change your political affiliation you must reconsider your position and go for a by-election ,Ford Kenya in line with the decision we have taken as CORD; we decided to declare their seats vacant .”Wetangula said .

Section 14 (5) of the Political Parties Act states that a person who, while being a member of a political party, joins another political party, in any way or manner, publicly advocates for the formation of another political party or promotes the ideology, interests or policies of another political party shall, be deemed to have resigned from the previous political party.

The Constitution in article 103 states that the office of an MP becomes vacant if, having been elected to Parliament as a member of a political party, the member resigns from that party or is deemed to have resigned from the party or as an independent candidate, the member joins a political party.
