Mombasa, KENYA: A 22 year old girl was on Wednesday laid to rest at Manyimbo cementry in Tudor within Mombasa County three months after her death.
This comes a day after Mombasa court ruled the deceased to be buried according to the Islamic religion which was her religion at the time of birth.
In court ruling Mombasa Principal Magistrate Henry Nyakweba said it was not clear in which religion the deceased believed, but said according to the evidence in court the parents of the deceased were Muslims and she should be buried according to Muslim religion.
“The plentiff did not prove religion of the deceased, evidence in court was was rumours,” he ruled.
The family of Zainabu Njoroge and Isaac Njoroge have been involved in a bitter court battle over the burial of their deceased daughter.
Zainabu Isaac filed a civil lawsuit in Mombasa court to be allowed to bury her daughter according to the Islamic religion.
This is after Isaac Njuguna Njoroge, the adopted father of the deceased, insisted to bury her in his Christian religion.
Yesmi Isaac died on 11th March this year in Mtwapa area within Mombasa County.
Magistrate Nyakweba also dismissed claims from plaintiff that the deceased earlier said when she died she wanted to be buried according do Christian religion.
He said there was no other witness who heard the deceased saying those words and maintained that it was an oral will which could not be relied on.
Zainabu Njoroge said that according to the court judgement justice had prevailed.
