Mombasa, KENYA: Mombasa court on Thursday morning freed 43 suspects of an organized criminal group known as Mombasa republican council (MRC).
In her ruling Mombasa senior resident magistrate Irene Ruguru said that prosecution failed to bring witnesses in court for a period of about two years.
Ruguru added that there was no evidence in court to convict the suspects.
Harun Nduria,Mambo Baya, Fredrick Kazungu jointly with forty others were arrested in December 2014 at Kaloleni area within Kilifi county for allegedly being members of THE unlawfully group MRC.
The defense council Mr. Joseph Karisa told Baraka Fm that his clients were innocent and challenged prosecution for not carrying out intensive investigations before charging suspects.
“Am happy that finally justice has been prevailed,” said Karisa.
Initially the court had ordered the suspects be released on a sh 500 bond or a cash bail of sh 80,000.
