A police officer faces fresh murder charges

A police officer is now facing murder charges after the office of the Director of Public Prosecution terminated manslaughter charges against him.

DPP Keriako Tobiko directed the court to withdraw the manslaughter charges and reinstate it with murder after perusing the man slaughter proceedings.

In a letter addressed to Mombasa Principal Magistrate Diana Mochache, the DPP recommended that the accused be charged with murder contrary to Section 203 as read with Section 204 of the Penal Code Cap 63 of the Laws of Kenya .

Mr Harrison Lang’at Kipngetich was initially charged with three counts of manslaughter where he was accused of unlawfully killing Police Constable Jacob Nderi, Ms Dorine Wawira and Ms Alice Kitonye on March 16, 2003 at Mtwapa police station, Kilifi County.

The accused had denied three charges of manslaughter he allegedly committed 12 years ago at a police station.
In the new charges, the accused would be charged with killing the slain officer, Ms Kitonye and Ms Wawira.

The accused who appeared before Mombasa Senior Principal Magistrate Richard Odenyo did not take a plea for the new charges.

Mr Odenyo directed that the matter be placed before a High Court Judge on February 2 for plea taking after receiving doctors report.

Last year, the accused bond of 2 million and was cancelled by a magistrate court after he was found guilty of failing to attend court for a period of over six months.
