The high school teacher was charged last week with defilement and indecent act against a 15 year school girl at Highridge Girls High School in Nairobi.
Milimani High Court Chief Magistrate Daniel Ogembo ordered that Hillary Okeyo be freed on a half a million cash bail or a bond of ksh.2million.
The prosecution had earlier opposed his release on grounds that he might be victimized and lynched by public.
The prosecution also claimed the accused would interfere with evidence especially witnesses if released.
The plea was however rejected by the magistrate who said the prosecution failed to provide enough evidence to prove that the accused would abscond court hearings or interfere with evidences if released.
“The accused person is a Kenyan Citizen and if he makes any attempt to commit indecent acts, the prosecution has the right to arrest him and bring him back to court,” said Chief Magistrate Ogembo.
The Biology teacher was accused of defiling a Form One student in a toilet at the school based at Parklands Estate Nairobi.
The incident was revealed four days later when students protested and boycotted classes accusing the school administration of a cover up.
The case comes for hearing on 24th November this year.
